Author’s point of view concerning optimal principles of diagnostics and legislation in Russia is formulated.</p></abstract><trans-abstract xml:lang="ru"><p>В статье прослежена эволюция подходов к диагностике алкогольного опьянения как доказательной базе правонарушения; описан параллелизм в развитии научных представлений о природе острого алкогольного опьянения (ОАО), научно-технических достижений с одной стороны и законодательства в области безопасности дорожного движения – с другой. Сравниваются два принципа диагностики – клинический и химико-токсикологический, их преимущества и недостатки.
